Terms of Service

These Terms govern access to and use of the Detailer Review System (the "Service") provided by Artivonix Solutions LLC, a South Carolina limited liability company doing business as Wellmon Systems ("Wellmon", "we", "our"). By activating a subscription you agree to these Terms.

1. The Service

The Service is a branded review and reputation system built and configured by Wellmon for the customer ("you"). It includes automated honest-feedback requests via SMS and email, a branded feedback page, Reviews AI, an auto-updating website widget, a video testimonial collector, QR code with analytics, Google Business Profile connection and health view, competitor tracking (up to 3), and mobile account access.

2. Pricing & Payment (Founding Member Rate)

The future standard membership price for the Service is $99 per month. The customer is enrolling under a $49/month Founding Member Rate made available during the initial rollout.

At activation, you authorize a charge of $59 - the first month's $49 membership plus a $10 deposit into your usable software wallet. Ongoing monthly membership billing is $49 plus actual usage (SMS, email, and AI), billed separately.

The $49/month membership rate remains available while the subscription remains continuously active. Cancellation ends the locked-in rate. A returning customer who reactivates after cancellation receives the pricing available at the time of reactivation, which may be the then-current standard price.

3. Term & Cancellation

The subscription is month-to-month and renews each month until canceled through the account cancellation process.

4. Software Wallet

A $10 minimum usable wallet deposit is required at activation. This is not a setup fee. Funds remain in your account and are consumed on a pay-as-you-go basis by SMS, email, and AI usage at rates set by the underlying third-party providers and disclosed in your account.

You are responsible for monitoring and maintaining your balance. If the balance is insufficient, usage-dependent features can pause until the wallet is topped up.

Treatment of any unused wallet balance at cancellation follows the policies of the checkout provider and payment processor in effect at that time, until Wellmon publishes a finalized wallet-refund policy. Once finalized, that policy will control.

5. Usage Charges

SMS, email, and AI usage are billed separately based on actual use. Rates depend on the third-party carrier, provider, region, and message type and may change without notice. Wellmon does not represent that usage is always inexpensive.

6. Build Guarantee

Wellmon will complete the standard build within 3 business days of the clock starting. The clock starts as soon as you complete and submit the onboarding intake form. No other prerequisite (wallet deposit, platform approvals, DNS access) is required to start the countdown.

If Wellmon fails to complete the standard build within 3 business days after the clock starts, your next month's $49 subscription fee is waived. Delays caused by third parties - including Google Business Profile verification, SMS carrier registration, email domain authentication, DNS, and other outside providers - are excluded.

7. No Results Promises

Wellmon does not guarantee any specific number of reviews, star rating, search ranking, leads, conversions, or revenue. Outcomes depend on your service quality, customer volume, response practices, and use of the Service.

8. Platform Dependency

The Service depends on third-party platforms (including Google, SMS carriers, and email providers). Their availability, policies, pricing, and APIs may change at any time and are outside our control. Wellmon is not liable for feature disruptions caused by such third-party changes.

9. Honest-Feedback Requirement (No Review Gating)

You agree that every customer will be presented with both the public-review option and the private-feedback option. You agree not to request configuration that filters, hides, or suppresses honest customer experiences from public review platforms. Requests that violate this section may be refused.

10. Acceptable Use

You will use the Service in compliance with applicable law and platform rules (including SMS consent laws, CAN-SPAM, and platform review policies). You are responsible for the accuracy of the contact information you upload.

11. Disclaimers & Limitation of Liability

The Service is provided "as is" without warranties of any kind to the maximum extent permitted by law. To the maximum extent permitted by law, Wellmon's aggregate liability arising out of or relating to the Service will not exceed the amounts paid by you to Wellmon in the twelve months preceding the claim.

12. Changes to These Terms

We may update these Terms. Continued use of the Service after an update constitutes acceptance of the revised Terms.
